Hi all
I was asked today by management if the gully waste could be manually loaded onto pick ups and taken back to the loading bays at the depot ?
My initial thought was NO on the account the waste must be hazardous thus treated that way , I have just found some guidance from DEFRA stating clearly that " although gully waste is classified as household waste schedual 1 control of waste regs. waste to be treated as household waste.
Any thoughts on this as I am not sure and dont want something thrown back at me
Thanks

Joe,
recently had a case where by we were taking Construction Waste (No Hazardous) from domestic premises to a centrally located skip in the middle of a housing estate. A visiting consultant "advised" our operatives that we were breaking the law and must cease all works! Even offered his advisory services to assist us. "Not FOC"!
After a quick bit of online searching and finally asking the people who know ie The Environment Agency I was told that the fact we had registered as Waste Producers with the EA and were monitoring things, such as Waste Transfer Notes and I followed a skip wagon to ensure it went where it said it was going was deemed to be more than enough as long as we did not leave the estate with waste.
The moral of the story is check with the EA, they will give you the definitive answer and are actually quite helpful. Honest.
Regards
Clive
