I have a member of staff returned to work after 11 weeks off sick with a knee injury...She went home early in April complaining her knee was hurting, and has just returned back to work.
On her return today she said that the injury was caused at work , which was the first her manager had heard about it, as there was no record in accident book or anywhere else.The person then produces a retrospective accident form from the accident book stating that her knee popped whilst at work no date just states "around mid-March"
This person isd well aware of our accident rerporting system , and location of accident book etc, but did'nt record it. Has anyone else experience this type of incident ? and is the accident report valid? I have a nasty feeling on this one were it may go.Any advise out there would be appriciated

Record the accident in the accident book and pay special attention to the dates and times recorded to ensure they are accurate. Compile a report to go with the report detailing the full circumstances of the delay in recording the incident and make sure the late reporting is clearly recorded as down to the injured party. Carry out what investigation you can and record all the facts about it. Then wait to see if there is a claim. Do your part in the reporting and investigating aspects of this case and you will not go far wrong in the eyes of the law. PS if you do find anything out of place that could have caused to accident, record it as found and record what action you take to prevent a repeat (that shows you have actioned anything that should have been done as a result of the accident and prevents another arising).

IMHO:
If your company allowed her to have 11 weeks off whatever the alleged cause) without chasing it up, you probuably deserve all you are going to get.
She has been watching afternoon telly all sponsored by the ambulance chasers.
Let her fill in the record , you start compliling history. Contact your insurance co.

Sad to say I have to agree with Walker, didn't anyone from the company keep in touch with the employee while she was off? You may well have left the door open.......................................

Not sure I'd go as far as Walker, record and investigate fully. Just because her knee 'popped' while at work doesn't make the injury 'work related'..

Investigate to establish whether it was work related. Does her job involve lifting, shifting etc?
Note in the report, that she reported late and if it is difficult to establish the cause say so in the report as well.
