We own row boats and kayaks, which we hire out to the public. They are obviously checked regularly for “lake-worthiness” and damage is repaired or the boat taken out of service. During the day there is a safety boat on standby. Our staff would like to borrow the kit and go out on the water in the evenings, when the safety boat will not be available. There is nothing to stop people sailing in their own time using their own boats, so I haven’t got a problem with them being there – it’s the fact they are using our kit. Once again, I’m concerned about liability and insurance.

Make a quick call to the insurance company and explain the situation Ian. The may ask you to wave any costs for damage etc. Also if users (public) are covered for accidents in works time does this extend to out-of-hours.

I agree with Zimmy's suggestion of speaking directly to the insurers, but my other thought is what type of body of water are you talking about and who owns it? The use of the equipment is one thing in terms of your public liability but where they use it will be the issue in terms of occupiers liability. Just a thought.....
