UK Universities do have their moments see http://www.bbc.co.uk/new...orthern-ireland-18190172 but they rarely kill people. This could be because H&S law in the UK applies to all employers including Universities. The Robens report specifically recommended that the Health and Safety at Work Act 1974 include facilities like labs as these had been missed out of earlier legislation.
In the US the Occupational Safety and Health Act excludes universities and there is no equivalent of section 3 of Health and Safety at Work Act 1974 to protect people effects by your work such as students as oppose to employees.
This could be why they are using this odd way of trying to bring a case against the University as the normal H&S laws do not apply.
