Morning All,
If a driver is in the rear of his van moving boxes, then the van is hit by a third party vehicle, the driver in the rear of the vehicle is injured, (bruised shoulder)and will be absent for over 7 days is this a Riddor or classed as an RTA? This happebned on the public highway

Hi - my understanding is that if the incident is connected with vehicle loading and unloading activities then it is reportable.

This is reportable as the employee was working in the back of the van at the time.

Yes it is reportable as the person was at work (representing the company) when the accident happened.

Unless he was moving the boxes off his van I don't think it sounds like loading / unloading, and it doesn't sound like specified construction / maintenance either.
Doesn't sound reportable, but you'd need all the facts - double check it against reg 10 of RIDDOR.

Don't we just love RIDDOR? I especially like the recent 'simplification' of the over-three day injury requirement. However, to refer to the question, I would not report it, as to me it is captured by the wording of Reg.10 of RIDDOR, the guidance to which states 'Regulations 3 and 4 do not apply to accidents involving vehicles moving on public roads', apart from some exceptions none of which, on the face of it, apply here,
