RIDDOR - failure of part of waste compactor

We have a waste compactor that was lifting 1100 litres bins and one lifting arm has cracked most of the way through. I am not sure if this is a RIDDOR reportable dangerous occurence under the regs schedule 2: 1. The collapse of, the overturning of, or the failure of any load-bearing part of any— (a)lift or hoist; Does this part of the compactor count as a hoist? Thanks in advance for your comments.

I'd report it. It was a lifting device and similar failures could be significant. If the HSE decide not to investigate further, that's their decision. If you fail to report, it may be your failing...

You say it has a crack in a load bearing part, but did it actually fail? Say you found the crack on a routine maintenance survey and repaired it would you report then. Not sure we have enough to go on.

I think that this is simple. If it fails when in use, reportable. If found to be cracked, not reportable. Cracked is not the same as failed.

Thanks for your comments. The crack opened up when it was in use. I have decided to report and also phoned the IOSH helpline who agree with me and advised the same. The compactor operates in a cage so even if the load had dropped it is unlikely anyone would have got hurt but it is the failure of a load bearing part so I am off to the RIDDOR site this afternoon to do my first dangerous occurence report - and log that on my CPD.

Good luck but I stand by my view - it did not fail - it cracked in use, rather than failed. To me it would have failed if the load actually fell.
