Hi all
Looking for some views .
If Construction company pays for a sub - contractors contract lift and then deducts the rate of the final bill of works. would the construction company be then seen as suppliers under sec 6 ?
So the appointed person , lifting plans , crane and driver are all covered under contract lift.
But if the worst happened then were would this leave the initial paymaster ?
This is due to basically foreign contractors who may not be able to gain trading accounts here in the uk
my view is the contractor would be in breach for but what for ?

Im not sure what you mean, but IMO should you not be using a UK registered crane company to provide contract lifts, where you can check insurances etc

Everybody is liable and would stand in the dock if something was to go wrong with the Lifting Operations certainly the PC.
The financial side is something that should have been sorted out before the sub - contractor took on the work and who was paying for what sorted out at pre-tender meetings.
I feel this is more a legal question than a Safety forum.

I am always wary when people use the term Contract Lift. It has a specific meaning where nearly ALL responsibilities for the actual lift, including crane selection, operative provision, moment by moment control etc, are transferred to the contract lift company. The PC is liable to his subcontractor for ground condition certification. Paying the invoice and then deducting the amount from the final account is NOT an issue.
If anything goes wrong the contract lift company stands well to the front except where liability not transferred in the contract is involved.

dec1888 - yes no worries there it is one of the top 2 crane outfits , well probably the biggest but thanks
Alex - agreed but tender awarded far to late for my likes but its not a new concept as we all know thanks
bob - I was reading article today from the crane industry and they are very surprised but also very happy about the huge turn to contract lifts as the margins very attractive.understandably there view is when we turn up to do a hired lift on a weekend sometimes the hirer is lets say somewhat in-competent. their view is we will provide a skilled service.but thanks bob that has cleared that up for me
