Can anyone tell me the answers to the below questions and where I can find a reference to quote please.
Is a LA permit required to erect a tube & Fit scaffold around a domestic property, where the front and or rear of the building runs up to the public footpath, resulting in the scaffold having to be erected on the footpath. (I say yes but stand to be corrected)
If you don't get a permit and get caught!!!! The only sanction is you have to get a permit. No IN/PN/FFI etc.
Need a pretty quick answer - plan is to erect the scaffolding in the morning against my advice!!

There is no legal requirement for an actual permit to work system. Each organisation has to decide what is appropriate for them in controlling high risk activities.

I might be wrong, but I think the poster is asking about a local authority permit because a public highway is being restricted. I would say yes - but each LA will have their own rules about duration, and such. A call to the local office will tell you in moments.

Sorry forgot to say that even out of hours there will be an EHO on duty who will probably give you chapter and verse.

Aah ha. You could be right there Tabs. However, FFI won't apply to LA and I'm fairly sure that PN's and IN's wouldn't apply to that type of issue would they? You could still get in trouble though.

Routinely, yes a permission regime is in place. Compliance and enforcement tends to be lax though - sometimes even by other divisions within that same LA!

I would highly recommend applying for a permit.
If they give you one it will say the scaffold should be netted (residents and ramblers don't wear hard hats) and also lights, usually at 3m spacing.
But you were doing that anyway :o)

Thanks for the replies.
Tabs, you are correct, it is a PTW that I was looking for, just permission to erect on the public highway. With regard to netting etc thats another issue.
Particular thanks to Sonia for the PM. That is exactly what I was after.
