Hi All - I pretty much think I know the answer to this but scenario; contractor employed by company to install racking system for warehouse. Client manager wants to start using the racking before the entire project is finished. Contractor happy for this to happen but will not sign it off and thinks it should be the responsibility of the client. the question is to be asked of the contractor - is it because you feel it is unsafe or because the project is not yet finished' but either way if the client wants to start using before the project is complete is it his responsibility to sign off? RA will bein place to ensure the work is continued safely and distance between working area for contractors and staff etc - but the question is who should sign it off - if the contractor wont is that alarm bells!?

I would guess this is partly a contractural or ownership issue, the contractor may be concerned that if the client damages the racking that they will then be expected to repair it at no cost. The contractor should be asked to confirm that the racking is safe to use, if the answer is yes then sign off should be irrelevant as long as the RA covering the client and his workers is in place and proper controls are in place to separate the client's and contractor's work.

If the contractor can't confirm (I would expect this in writing) that the racking is safe to use until the project is complete then the client should wait as any damage or accident would be at the client's risk.

Hi DaisyMaisy,
Have put my Contractual head on in lieu of my Safety Head.
The Contract will probably state something like: 'The contract shall not be deemed to be complete until such time as all works are completed to the required standards and to the satisfaction of the Client. This shall include all hand-over certification, Operation and Maintenance Manual and relevant Sfaety Data', etc, etc.
The contractor is probably reluctant to allow the client to use part of the racking installation until such time as the client has accepted that section in case of damage, etc.
I would suggest the contractor and client agree a phased-handover, whereby both parties undertake an inspection of the racking section that the client wishes to take possession of, formally record the condition of the racking, contractor carries out any remedials required and, once done, both parties sign that the racking is acceptable.
Another thing to consider, which should be contained within the Contract, is whether the racking has to be weight tested prior to use. In this situation, the client would also need to accept any additional costs associated with the weight testing as the contractor will most probably have allowed for this to be undertaken in a single visit (probably by a 3rd party).

They should get to use the racking when its complete and signed off.

Imagine if they start loading up at one end, and the dominoe effect comes along at the other end of the racking.
