I would be grateful if anyone can provide me some clarification on the following scenario. A private business in the Health sector is run by a husband and wife team. As Clinical Directors they pay themselves a wage. There are two Administrative members of staff who each work a 32 hour week and one part time Administrative assistant who works 4 hours a fortnight. There are 12 self employed practioners who provide services for the business. The business has premises in three different geographical locations. Does the company now full under Reg 3 of the MHSW Regulations 1999. Recording there findings. Brett

5 or more employees is the trrigger for recording - so with five employees plus the freelancers I would say yes - even though some of the staff are part time - I am not aware of the regs making any allowances for part/full time employees. 5 or more regardless of part time or shift work.
