We are shortly going to be installing a new production line inside an existing building, the foundation works were completed at the same time as the original line went in as the full intention from the outset was that the second line was to follow within a couple of years. The only work will be the installation of machinery and connection of services, this work will take more than the 30 days/500 hours to complete, but is it classed as construction and therefore notifiable? (we will be following the principles of CDM even if its not notifiable). I have looked at the ACoP and can not see anything that leads me to believe that it may be one or the other, however it is Friday afternoon and its been a long week

IMHO the work is covered by the definition of Construction Work with the CDM Regulations. Regulation 2(e) defines it as the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure,

I would agree L144 states: “construction work” means the carrying out of any building, civil engineering or engineering construction work and includes— the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure, http://www.hse.gov.uk/pubns/priced/l144.pdf page 62

In that case, the tip for all practitioners new and old is to look at the start of the regs in those sections called Citation Commencement Interpretation or for ACoPs Definitions or similar. They can all be quite illuminating!

PH2, F500 and Carol B(for the first time), have you ever actually notified such projects and was their any action from the HSE?
