Hi, Could anyone offer some advice with the following; I work for a large Global organisation with several operations in the UK. However, after some restructuring of the organisation we, both in the UK and other countries within Europe, do not have local Directors or Managing Directors e.g. no "controlling mind". I am trying to help the UK re-write their H&S Policy statement and want to know . . . . does it have to be signed under law? does there have to be a "controlling mind" identified? or, can a simple "statement" be suffice? There will be a 'controlling' mind in the UK as it does not need to be a director - so give the problem to that/those persons who are in the highest rank Come across this before; similar to money ---------- where the fat cats are hidden abroad and those here are operating to their orders but are at risk with little compensation for that risk

Hi Bob, I'm not sure the highest managers in the UK (plant and area managers) have complete budgetary control over safety and in fact one area of the business does not have a safety advisor / manager / competent advice as the role was made redundant during a previous re-structuring.

It is likely that you Corporate Company will have a UK registered ( company house) legal entity despite the Corporate Controlling Mind not resident in UK and also not a director of the UK registred company. Then, it should be one of the Directors of the UK registred company, as in law it will be recognised as the "employer" My employer is a global Corporate. The CEO has endorsed the Corporate policy, but the UK Site and Organisation policy is endorsed by one ogf the directots of the UK registred company who has specific accountability for Health & Safety.
