Hi all

We have a conveyor that is hung one end by chains. these look substantial chains and are correctly fitted using correct eyes and fitments.

My question is do they

1. Become part of the structure and therefore exempt from the Loler regs.
2. Still remain within the Loler regs and require periodically testing

Thanks

Steve

Hi Steve IMHO if they are supporting a load they will come under LOLER and as such require certification.

You may want to go through the useful HSE Operatinal circular that has a detailed "guidance".

http://www.hse.gov.uk/fo...s/ocs/200-299/234_11.htm

para 28 states that:-
Machinery, whose primary function is not that of raising or lowering but which includes some integral part performing a lifting function, eg the boom of a mobile concreting pump or a tipper lorry which raises its body to discharge the load, should not be regarded as lifting equipment. This exclusion extends to chains, ropes and lifting tackle forming an integral part of the plant, for example counterbalanced furnace doors or dock gates. Machinery which lifts itself, eg roller shutter doors, is also not considered to be lifting equipment.

In any case, through PUWER Regulation 5; Maintenance and Regulation 6 Inspection there will be duty to maintain & inspect

They are wrapped around a disused overhead crane track and double back so both ends are connected to the conveyor.

The crane track used to support a 50 tonne over head crane

I've no doubt they are still open to Inspection/Maintenance but Jay seems to have provided possible evidence that they are excluded from loler.
My only reservation would be if the chains were originally intended for a different use.

Thanks Jay

I think that answers my question.

Do not have to be certified under LOLER but under PUWER must be inspected.
