Hi all
Can anyone point me in the right direction to a document that outlines clients legal obligations/duties. Also, local authorities legal duties (a brief guide).

jarsmith - are you referring to Construction or another area of "Client"?
If construction - go to HSWA; MHSW & [especially] CDM. If non-construction client; forst read CDM for the true definition of "Construction Activity" and then go to HSWA & MHSW.
Also, just to ensure relevant responses, in what context do you wish to know about the LA legal duties?

Frank Hallett Hi Frank, you have directed me to where I initially looked so that's great stuff. With regards to LA, I just want clarity as what their involvement should be in managing their PC. The activities are a mix of general maintenance and minor construction.

I'm now somewhat confused - are we to understand that the LA are the Client here rather than the enforcer?
Is this anything to do with your other concurrent post re CSs?

Frank Hallett Ha, no its not. Basically, the LA is the client e.g. london council, suffolk council etc etc...

For construction related activities CDM Regs apply and I suggest you donwload the free ACoP from the HSE website.

In addition to the client duties in CDM and the guidance in supporting ACOP, there's additional guidance on the ConstructionSkills website.
Also guidance on procurement issues on the waste pages of HSE site, the principles of which could be applied to procuring maintenance and minor construction.
General principle that you can delegate including via contracting, but you can't delegating taking steps to assess whether the contractor is performing safely (not an absolute duty but sufficient steps).
