Case 253 Child not allowed to use shop toilet. Apparently it's ok to allow a 5 year old child and parent into the back area of a shop, probably through storage/warehouse area etc to use a toilet. There are no health & safety reasons not to. I'm sorry but how can this not be a health and safety issue? I accept there is not specific legislation but this is where risk assessment comes into play. Be interesting to see if the HSE view was the same if the child got hit by a forklift truck because they didn't stick to the pathway (even the best behaved 5 years don't always follow the rules)

Many retailers wont allow customers back of house for security reasons - accompanying children into back has been used as a front for criminal activities - theft etc. Retailers do and have to apply generic controls to there premises and this can sometimes frustrate customers - it is very difficult if you have portfolio of 2000 stores with a vastly varying in design to apply a case-by-case approach. In the case you mention e.g. big DIY store many will have customer facility's anyhow.

Just to be pedantic. Surely the applicable regulations require employers to provide welfare provisions for employees only. I wasn't aware that the regulations covered non-employees in retail outlets that do not serve food or drink. Having used a staff toilet in a shop before I wouldn't recommend it to anyone, it was in a worse state than the public toilets.

I think the point being made is that H&S is used as an excuse, rather than saying "No, you're not allowed". Some organisations think this shows them in a better light and it's all "I would if I could but its against H&S". If the toilet is in a warehouse and there are forks about then of course its H&S and they will have done assessments to strengthen their case.

The reference was to a "Shop" --whatever we think a shop means. It is ultimately down to customer service and for franchises that have "HQ policies" not much room for flexibility plus it is easy to use elf & safety as the excuse. Shops are unlikely to have FLT's . Just shows what our society is coming to by having such "controls".
