On the HSE website it states "Head protection. Does the law require head protection on construction sites? Yes. On almost all construction sites there are situations where head injuries could happen. The work should be organised to minimise this risk, for example: preventing objects falling by using scaffolds with toe boards and, if necessary, brickguards"
The question is which regs cover this now that the Construction (Head Protection) Regulations 1989 have been withdrawn?

Is it not now down to a risk assessment (Management Regs) to determine the risk controls needed?

Interesting but the HSE website says clearly "Does the law require head protection on construction sites? Yes."
The PPE regs DO NOT STATE THIS. So which law is the HSE talking about?

I know the HSE ask about wearing hard hats when there is no overhead hazard, but if it can be explained they will accept.

Does the law require head protection on construction sites?
Yes. On almost all construction sites there are situations where head injuries could happen. The work should be organised to minimise this risk, for example: preventing objects falling by using scaffolds with toe boards and, if necessary, brickguards.
But if even after doing this, risks of head injury will normally still remain and you should:
Ensure all workers are provided with, and wear, suitable head protection.
This is necessary to comply with the personal Protective Equipment Regulations 1992 which, from 6 April applies to the provision and wearing of head protection on construction sites following the revocation of the Construction (Head Protection) Regulations 1989.

One should also perhaps remember that if a client requires it within the contract as a client rule or the PC makes such a site rule, of his own decision, then the requirement has legal force even if the standard being enforced is more severe than the PPE regulations themselves.
