Please accept my apologies for raising this issue again but I am trying to get a definitive answer to the type of Asbestos Survey now required by the CAR 2012????????
When I look on the HSE website for information about what changed in the asbestos regulations in 2012 this is what I get,
The Control of Asbestos Regulations 2012 came into force on 6 April 2012, updating previous asbestos regulations to take account of the European Commission's view that the UK had not fully implemented the EU Directive on exposure to asbestos (Directive 2009/148/EC).
In practice the changes are fairly limited. They mean that some types of non-licensed work with asbestos now have additional requirements – notification of work, medical surveillance and record keeping. All other requirements remain unchanged.
I have a copy of the Managing and working with asbestos ACOP and at paragraph 113 there is information - finding out if asbestos is present including surveys (management, refurbishment and demolition, and also at para 117 "there may also be previous assessments and surveys or other existing documents which can be consulted".
Every time I ask the question I get told that Type 1, 2, 3 surveys are no longer allowed to be used, but where in the ACOP, or the Regs themselves for that matter, does it say they cannot be used?
I occasionally meet resistance when I request asbestos surveys to be done, the cost is the reason for that of course, and I would just like to be super confident when I answer.

If you have an old asbestos survey (type 1,2 or 3) then that should be suitable to assist in production of an asbestos register and management plan.
For more extensive works. If you already have a thorough type 3 survey (and by thorough I mean fully intrusive with no caveats) then that should be suitable and a further demo/refurb survey should not be required.
If you have a type 1,2 and are having construction works done then these will not be suitable and you will need to get a demo/refurb survey.

Hi Paul, thanks, that's what I thought. Type 1 and 2 were never intrusive therefore cannot be considered suitable, that is my thinking but some people think otherwise and refuse to be persuaded.
Here's a "what if" for you:
What if refurbishment works were carried out pre 2012 using Type 2 survey reports, and further refurbishment is planned to the same areas as previous, does this now need a Refurbishment survey to the areas that were fitted out as new?

I would say it depends on a number of factors. .
Was asbestos removal undertaken as part of previous refurb works and to what extent Ie total removal or encapsulation. ( check surviving documentation).
Is it possible that, given the nature of the area that there could still be asbestos present that wasnt picked up on the original type 2 (ie in hidden voids, roof spaces etc) and therefor wouldnt have been removed? Or was it stripped back to just a brick shell with no hidden areas.
I would say unless you have a very good reason to assume that no asbestos is present then get a refurb survey done.
