I have spotted a couple of the old 1999 posters still being displayed in a couple of organisations I have visited in the last couple of weeks. On each occasion I have politely pointed out that they should have been replaced with the new version by the 5th April 2014. (These were both at potential suppliers we were visiting).
By not showing the 2009 version of the poster, they will not be complying with the Health and Safety Information for Employees Regulations (HSIER), but what penalty, if any, might be imposed for not replacing the poster ?

I would have thought either the HSE or LA officer have got better things to do than prosecute a company for failing to display the poster.

It is a technical breach and I am not sure what the potential penalty is. Unless the inspector was particularly zealous then I would have thought that FFI or enforcement is unlikely; as above I am sure that the HSE/LA have far bigger fish to fry.
For the most part I would suggest that the display or not of the poster or the correct poster adds little value to the management of risk.

To be fair, the ever competent HSE have been out of stock for the past month or so and dont expect to have any more for at least another couple of weeks. Think I'd be pointing that out if anyone asked why I wasnt displaying one ;-)

Why don't you download the free version which can be run off either A4 or (I believe) A3. This will save just under a tenner.

Employers have a legal duty under the Health and Safety Information for Employees Regulations (HSIER) to display the approved poster in a prominent position in each workplace or to provide each worker with a copy of the approved leaflet (available as a free download in alternative formats) that outlines British health and safety law.
The above doesn't explain how this is to be done. If your employees have access to computers then the poster could be provided that way?

I have and it worked a treat - As I type this post I can look up and see the H&S Law Poster on my H&S Notice board along with the HSE booklet "Easy Read Guide".

Due to soe acquisistions, I have over the last couple of months needed to order some of these for new sites brought into the Group. However, both my preferred and alternative supplier are still out of stock. They have been advised by HSE that as long as replacements are on order (and this can be proved - which it can) then no action will be taken until after poster orders have been fulfilled.
I agree there is the possibility of using/ printing the downloaded version, but to be honest, I prefer the 'wipe clean' version, and not all sites have access to laminators (or A3 printers for that matter).

Interesting I did not know you could download the poster its crown copyright? Probably get fined more for doing that than not displaying it at all! It was my understanding that you bought a poster or gave EVEY member of staff the leaflet.

Interesting had not come across this before - but I have seen the arrow logo before. It was a part of a national funded organisation set up to help with H&S but the name escapes me at the moment. Workboost is clearly NOT the HSE and like peter I still think its the one product you have to pay for or download the free leaflet for each individual.

The poster is also available hardcopy from lots of trade suppliers, including those that sell screws and fixings. A search of stock at local branches of one particular such company has shown that most have a couple in stock. I imagine their main warehouse has greater quantites should you need them and could be ordered online.

Morning all
I have to correct myself and say that I have displayed the Leaflet and not the HSE Poster. Looking at the cost from the HSE it is about £9.00.
Safety Smurf - I note some trade suppliers are charging as much as £16.00 - rip off springs to mind!!!

In 2007 that arrow logo was on a Welsh only scheme called Workplace Health connect - who were also in partnership with the HSE (not a Welsh HSE). I had a series of DVDs and Booklets from them Free, covering DSE, Stress,Hazardous Substances, Noise, sickness absence, manual handling. As they were free I asked If I was allowed to copy them and give to a sister company in England - I was told NO. I recall them telling me they were funded year to year at the time so who knows how long they will last if it's the same lot rebranded.

And when you do "acquire" your new poster what added value does it deliver? The printed contact number has been discontinued and you invariably cannot contact your local office by telephone any more. Send an email and if lucky you may get a response...... some time.

Thanks Chris Workplace Health Connect also operated in England i had a couple of their bookelets as well I could just not remeber their name and dont know where i put their booklets - found them of little use compaired to ACoPs and HSE guidance.

Snap - I also found the ACOP's etc better. It was supposed to be for small to middle sized company's and we were just within the limit of 250 employees. Realistically I think they were more for smaller company's with no H&S person. They were still in the box they came in, when I dug them out to look what they were called. I think after I read the booklets and watched the Manual handling DVD - I decided not to use them either.

I tend to agree and hence my post at 3.
Interesting to see that it appears that it can be downloaded though as it doesn't appear to allow reproduction under the open government licence.
