Hi all, If an employee suffers and injury at work and is off for 3 days. They then return to work for 2 days and due to a reaction to medication then goes off for a further 2 weeks - would this be RIDDOR reportable. They did return to work following the inital incident and the second lot of lost time was due to the medication no the incident. Thoughts please?

Hi Colette, The Employee has to be off for 7 day's, this does not include the day of the incident/accident. My understanding is, if he came back to work before the 7 day and went off work again then this does not need reporting. Thanks Rob.

Hi, I would not report this unless the injury/incident fell within any other category within Riddor.

Hi Colette, I think the key to this problem lies in your comment that the second absence was due to the employee's medication. I would take the view that the second absence was a period of illness and thus is not reportable.

I agree with Farrall. It would have been RIDDOR reportable however if the second absence was not due to the medication but the original accident as they still had more than 7 days off (further 2 weeks) regardless of the fact they came back to work for a few days then went off again.
