After a long and arduous H&S audit, I was asked if we make deliveries using 'crane-off-load' vehicles; saying 'Yes we do', the auditor then said you may well come under the CDM regulations as we also make 'In-Situ' deliveries for construction whereby the driver unloads the product(s) and deposits them in a specific and measured point. (Lift Plan always required for this type of delivery, although a 'Generic Lift Plan' is submitted for normal deliveries). Hence his query about coming under these regulations. I just wondered if anyone else is aware that this may be the case (or Not).

Are you carrying out construction work when you go onto a construction site? No, your driver is just unloading. See definition of contractor in CDM - it's not you, so you are not duty-holders under CDM. BUT, you are going onto a construction site so subject to the PC's site rules as they are the person in control of the workplace. See all the usual sources re cooperation and coordination, shared workplaces etc. If the auditor tries to push the issue, you will be seeking clarification I trust?

Hi Jim. Yes the PC has the control, and usually asks us for either a Generic or detailed Lift Plan of which I am an A.P. We mainly deliver to construction sites with our products. And again Yes I will be seeking clarification on this one.
