Hi Could someone advise me ..... would work on a grass verge (outside pavement) be classified as Highway and would this work require competent Operative / Supervisor to NRSWA?

The term Public Highway includes all footways and verges of whatever material. In broad terms the answer is yes. Of course you could check deeds and LA plans and find that there will be some exceptions. It is like most rules - there are exceptions. Bob

Lindley, Bob is right. There may be utilities (e.g. electricity, telecom etc) under the verge so NRSWA supervision is strongly recommended, and cat'n'jenny Note: whatever work/tools you use you should provide a barriered safety zone to keep the work clear of passing pedestrians, preferably 1 metre wide. That zone might encroach onto the footway, so if you have restricted the footway to less than ~1 metre wide then should erect a barriered temporary footpath beyond the far side of the footway. John

If the works are not for utility purposes, such as BT, Gas, Water, etc. then there is no legal requirement for employees to hold any qualifications required under the New Roads and Streetworks Act. If the works are under a Section 50 Licence with the local authority you will need to comply with any conditions set out in this. Streetworks qualifications are for utilities and their contractors, not others who may work on the highway, although it is good practice for a basic level of competence. As given, the highway includes the verge and if in doubt if the area comes under the Highways Act then contact the local authority to see if it is an adopted highway. For any signing of the site you can use the Safety at Streetworks and Road Works Approved Code of Practice, or Chapter 8 of the Traffic Signs Manual. if excavating then also refer to HSG 47. All these documents are available for free download (google them)
