I would appreciate some advice regarding CDM and whether a particular piece of work is notifiable.

The work being undertaken involves a number of smaller jobs and whilst each job will not be notifiable the accumulated time for the project will go over the notifiable limit of 30 days. Based on information I have seen on other posts on this forum I am therefore assuming the project is notifiable.

The area I therefore still require clarification around is the definition of 'Construction' and whether the work being undertaken falls under this definition.

The work involves the installation of CCTV cameras at a number of sites. All will be attached to lampposts at the sites, power is available within the lamppost and the video feed will be wireless so no excavation will be required. All will be installed by a competent electrician.

Within the CDM regs under the definition of construction is the following: -

(e) the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure,

Also within the regulations a Structure is defined as follows: -

“structure” means—
(a) any building, timber, masonry, metal or reinforced concrete structure, railway line or siding, tramway line, dock, harbour, inland navigation, tunnel, shaft, bridge, viaduct, waterworks, reservoir, pipe or pipe-line, cable, aqueduct, sewer, sewage works, gasholder, road, airfield, sea defence works, river works, drainage works, earthworks, lagoon, dam, wall, caisson, mast, tower, pylon, underground tank, earth retaining structure or structure designed to preserve or alter any natural feature,
fixed plant and any structure similar to the foregoing; or
(b) any formwork, falsework, scaffold or other structure designed or used to provide support or means of access during construction work,


My question is this. Under the above definitions would the lampposts be defined as a structure?, as if so I believe this work would be notifiable, which seems a little excessive based on the nature of the work being undertaken.

Terry, you've answered your own question, I think. In my opinion, yes, it's notifiable.

I think it's notifiable too.

The lamp-post would not be a structure with respect to the design of it - that is, the lamp-post designer is not a designer under CDM, but a project installing lamp-posts would be a project under CDM. Specifically to this case, I think installing CCTV to teh posts would fall under CDM, and therefore if you're installing enough, would be notifiable.
