The company I work for, which makes Handmade Biscuits, Crackers etc, employs a young person (17) who would like to start work prior to 06:00 and obviously finish earlier.

I have found a leaflet from TUC Worksmart entitled Young people at Work. Part of the working hours/night work information provided states that a young person can work from 4:00am if they work in various industries, one of which is working in a bakery, which this company is classed as.

My question is, where these regulations which state that time and industry can be found, does anybody know?

I have looked at the Working Time Regs, but I can find no mention of the information above. I need to clarify if it is correct a) so the young persons wishes are granted and b) to put references of the legislation onto the young persons risk assessment.

Any help would be appreciated.

Sorry can't find it and I looked in my Redgrave's going back to the Children and Young persons act 1930 and the Employment of Women,Young persons and children act 1920!
Could it be a bye-law?

I already have those leaflets and I did find a few more from various other bodies all with the same information, but no link to the legislation, hence the query

Kildaman, maybe it has simply become accepted as ‘work of an exceptional nature’
WTD (4) The requirements in paragraph (2) do not apply in a case where the work a young worker is assigned to do is of an exceptional nature.
The TUC guidance that John references is quite specific about the 0400 start time for bakeries. That is unlikely to have been published unless some form of agreement/acceptance exists that it is. I cant think of any other specific obvious legal ref.

Found it for you!!

The Working Time (Amendment) Regulations 2002

(3) Regulation 6A does not apply, except in so far as it prohibits work between midnight and 4 a.m., in relation to a young worker employed in—
(a)agriculture;
(b)retail trading;
(c)postal or newspaper deliveries;
(d)a catering business;
(e)a hotel, public house, restaurant, bar or similar establishment, or
(f)a bakery,
in the circumstances referred to in paragraph (1).

Not quite right the article say's there are special limits on the hours you can work at night. You cannot usually work between 10pm and 6am. (usuially being the key word). It goes on to sat that there are some exceptions for young people who work in hospitals, agriculture, retail, hotels and catering, bakeries, post/newspaper deliveries, or in connection with cultural, artistic, sporting or advertising activities.
