I came across this brilliantly written thought provoking article whilst trying to get my head around common and statute law for my diploma studies.

Hello sailor!
If you follow any of this diatribe in your Diploma Law exams I see tears before bedtime.
I don't think I've read anything so absurd in ages.
I think there are many things wrong with our law but this approach and its conclusions are farcical.

Interesting piece it is such a shame that present Govts can not see the advantage of Courts, the Right to Silence and Double Jeopardy. Actually one can face very serious charges and whilst the Police are represented by a QC paid via our taxes you may not even have a Solicitor unless you are unemployed etc.

This article is bilge.
I am not saying that the way that law is taught on NEBOSH courses in brilliant (it isn’t and there are loads of mistakes and over simplification particularly in relation to statutory interpretation) but this article is written by some google-eyed loon with an axe to grind.

It made me think that the author would be better off emigrating to a remote stockade in rural USA along with the other free spirits who want to withdraw from the rest of us. Although if he's still in jail that may not be a realistic scenario as he'll never get past the US border agency.

Ooh boy, that there internets sure breeds em! Common law is merely judge made law, as we all know, and is neither more 'natural' nor more rooted in society than statute law.

But why waste time arguing, I have to agree with AK and DB who summed it up beautifully in posts above,

Some nice opinions out there. Anyway I standby my opinion "brilliantly written and thought provoking" which does not mean to say I intend to use it as part of my studies lol
