Good Afternoon

I have come into work this morning to discover that an incident occurred on the Friday night shift. It was a regular temp employed via an agency that had the incident. Apparently he was using a dolly that had a stiff wheel to move a full pallett of plastic parts. According to the person the wheel was stiff and caused to it spin away jarring said persons back and trapped the sciatic nerve.

He did not go to hospital. I am also looking into the process of work and the root cause, evidence of training records, SSOW, maintenance records of equipment, reports of any defects on said dolly, declaration of any pre-existing and/or existing conditions before commencement of work, etc

Now the site is on annual shutdown with the exception of a few key admin personnel. I am waiting on a response from the agency to see if said temp has commenced any other work or have been signed off by their doctor and all other personnel that I want to speak to as part of my internal enquiry will be back into work until 18th August. My quandry lies with that if this become a RIDDOR due to incapacitation to work (I am purely spectulating here) where do I stand with the reporting time?

I have looked at the HSE site but any guidance would be appreciated.

As far as I am aware it should be reported within 15 days of the incident taking place.

I would report it. If it turns out to not be a riddor, well it's cost the time of sending a form. If it is and you don't report, theres going to be a much bigger cost involved

Just to add some spice - I do love a good RIDDOR debate - the duty is on the employer to report under RIDDOR.... This is surely the agency?
Now you can of course report on their behalf, but they are the employer...
Or are they?

Just to play devils advocate (because I've become very cynical in my old age) if he didn't go to hospital and you haven't heard from him or the agency, who made decided that he trapped his sciatic nerve?

I'm always suspicious of accidents that happen on Fridays, Monday mornings and when the world cup was on (father and son both managed to have the same accident, a day apart, at the same time in the morning both off site....)
