Another RIDDOR query I am afraid. I have had an incident reported to me regarding an injury to a tenant within one of our homes and they were taken to hospital. Should these be RIDDOR reportable because of this fact? Looking at the Regs - I have classed this as a 'non employee' on a work premise (it is owned by us) Should it be reportable if it actually happened at a place of work e.g. Head office or does the fact that the home is owned by us mean it is a RIDDOR? On closer investigation it appears that the incident was largely due to tenant factors (amongst some others) however, I still feel that it should be RIDDOR. What is everyone else's view?

Looking at the guidance you only have to report if the accident is work-related, Here is what the guidance says
When deciding if the accident that led to the death or injury is work-related, the key issues to consider are whether the accident was related to:
the way the work was organised, carried out or supervised;
any machinery, plant, substances or equipment used for work; and
the condition of the site or premises where the accident happened.
If none of these factors are relevant to the incident, it is likely that a report will not be required.

If this is a tenant in a domestic property (their home) then I don’t see that this would be reportable under RIDDOR. That the property is owned by you doesn’t necessarily make it a work place and in the majority of cases I very much doubt it will be, at least from the tenants perspective.
If the same person with the same status (a person not at work) had an accident at your premises AND this satisfied the criteria for a report (taken DIRECTLY to hospital, by whatever means, for treatment AND this was the result of ‘work’, then this would clearly be reportable.
From your current ‘brief’ I think you’re barking up the wrong tree to suggest that a tenants home is a workplace (of course it could be in certain circumstances).
If ‘you’ were carrying out work at the tenants home and the accident occurred as a result of this (you don’t actually say that this is the case) then I am still not convinced that this would be reportable under RIDDOR. Others may have a different opinion.
