Night Working - Are Health Assessments Compulsory?

Hello everyone,
Can someone please tell me if it is compulsory for a night worker to complete a health check questionnaire? I need to know so that I can add it into a template H&S Policy.

Its compulsory to formally offer a night worker health surveillance, which is typically a questionaire. But if the night worker declines the offer then the surveillance is not required.

Health 'assessments' for night work are covered in Working time Regs 1998. Part 2 para 7.
This includes the phrase "opportunity of a free health assessment at regular intervals of whatever duration may be appropriate in his case."
So whether that is considered health 'surveillance' might be a moot point I guess but the principle of on-going checks is clearly present. Was that the basis of your question?

We have a perment night shift and yes you should offer them a free health surveillance. We offer this once a year, but it is entirely up to the employee if him/her takes it up. But to answer the question no it is not compulsory for any employee to have or accept the health surveillance.

There is an ACOP and sound advice on the HSE website. I have just managed a company of steel erectors working 12 hour night shifts from January to August this year.
Found it very helpful.
