Hi All I was just wondering if anyone could help me in the interpretation of the welfare regs and how they apply to workers such as waste operatives. We have operatives who (have recently decided due to changes in their T's&C's) travel across the borough to return to the depot to have their lunch. I also have the feeling I will be grilled about this during their annual training in December, so would like to be prepared! We have facilities across the borough where they can stop for loo breaks, but what are the requirements for them with regard to eating lunch etc? We have management and unions at loggerheads ! Without knowing exactly what work they are doing it is difficult to say. Regs say that: 25. (b)include suitable facilities to eat meals where food eaten in the workplace would otherwise be likely to become contaminated Which you are meeting from the sounds of it. They also say: 21. (1) Suitable and sufficient washing facilities, including showers if required by the nature of the work or for health reasons, shall be provided at readily accessible places. So you will certainly need warm water, soap, sink and dry hand towels for the washing of hands, forearm and faces prior to your guys eating. Do they end up covered head to toe in waste? If so, showers may be required too. Of course if they just wear overalls they should be able to take these off, then wash and eat. But that means this reg comes into play: 24. (1) Suitable and sufficient facilities shall be provided for any person at work in the workplace to change clothing in all cases where— (a)the person has to wear special clothing for the purpose of work; and. (b)the person can not, for reasons of health or propriety, be expected to change in another room.. (2) Without prejudice to the generality of paragraph (1), the facilities mentioned in that paragraph shall not be suitable unless they include separate facilities for, or separate use of facilities by, men and women where necessary for reasons of propriety. So that's different changing areas for men and women and somewhere separate for them to store their overalls from where they are eating. thank you ! this was what I was hoping for ! Our operatives do general and brown waste, which 95% of the time is contained in wheely bins. They don;t have overalls persay but a uniform is provided and i believe that vehicles have hand washing facilities avliable but operatives don't like them ! I think we have the basic requirements covered, really appreciate your help!

Try a day out with the workers to get a feel as only then will a person get a full picture and go from there noting that in my experience [>20 years in waste management] basic washing facilities are usually poor especially in inclement / winter weather and if possible get a fair minded and decent manager to go out with U. Additionally I would confirm just what is meant by 'uniforms' as usually its PPE that is provided abet in the form of a uniform Personally I find that we are dropping standards all of the time especially with regards to mobile workers

So they can wash their hands in the dustcart, but still remain in their [extremely filthy] workclothes? Not really ¨meal hygiene¨ is it? But then this sounds like another of the ¨them and us, and us is better¨ threads. I don´t recommend going out for a ¨day with the lads¨ (you may get dirty)
