Hi, With all the changes to CDM about to go live, working in the Construction Industry I know what, if any, changes it will have to my organisation and my role. But, a very good friend of mine works within the Events and Theatre Industry, he runs his own Audio and Visual installation company carrying out installs at shows, festivals, etc. Now, in my ignorance, I hadn't realised that the CDM was now going to be applicable to this industry. In all fairness, he does already produce RAMS for his works including getting his guys trained for WAH, MH, including getting them through PASMA and IPAF courses. Now my question to you guys is this, what are the effects that CDM 2015 are going to have on the Events and Theatre industry, in particular, my good friends Installation Company? There is no new scope to the definition of construction that suddenly brings the events industry into CDM. The definition of construction has not changed. However, some parts of the events industry has got its knickers in a twist and seems to have decided the whole point of cdm2015 is that the evil HSE wants to expand its reach and get its claws into the events industry. Hence the industry is doomed, all trade shows are going to be doomed, everyone working in the industry is going to be locked up, it's all doomed, etc. It's rather like the architects when CDM was first invented - the end of creativity, no more great buildings, architects will be locked up, and all future buildings will be two-storey rectangular boxes festooned with guard-rails. http://www.hse.gov.uk/event-safety/faqs.htm#q2 : "The erection of some temporary demountable structures at entertainment events falls within the definition of 'construction work' in regulation 2(1) of the Construction (Design and Management) Regulations 2007 (CDM). However, HSE policy is that the CDM Regulations do not provide a useful regulatory framework for temporary structures used in the entertainment industry. " http://www.hse.gov.uk/en...eatre-tv/open-letter.pdf : "The current and proposed CDM regulations apply to construction work in whichever industry it takes place, although HSE has not actively applied CDM in entertainment workplaces. This approach acknowledges that the industry’s organisation and contractual arrangements are different to traditional construction projects, and that burdens could result for those businesses undertaking small‐scale, low‐risk construction work. Instead, construction risks have been managed through compliance with the Health and Safety at Work etc Act 1974 and other associated regulations.    "The proposed simplification of CDM together with the diverse range of construction activity and associated risks undertaken across the entertainment sector prompted HSE to review its approach in the lead up to and during the recent CDM consultation.  We remain committed to working with the industry to ensure that the application of health and safety law to construction work continues to be both proportionate and effective." CDM2015 per se will have no effect. The ongoing review of what the most appropriate regulatory approach to the events industry will be might have some effect. However, I would generally regard a periodic review of whether the regulatory approach is appropriate to the way an industry has developed to be a good thing.
