Hello everyone, I hope that you are all well this evening? A quick question, what are the significant differences between the English Fire Safety Order and the equivalent Scottish fire Regs please? My understanding is that a risk assessment is required, is there anything else that I might have missed from our Scottish Cousins? Thanks DHM (Be nice)

First up - In Scotland it is an act of Parliament within itself and a regulation thereafter - In England and Wales the RRFSO comes under the scope of the HASAWA. The main significant differences is in Scotland we have the 'Duty Holder' in England it is a 'Responsible Person'. The Scottish regulation talks about the 'Relevant Premises' but doesn't in England. In Scotland there is no crime of arson its called wilful fire raising. The Scottish regulation puts duties on Employees, I'm not sure if the RRFSO does? But apart from the above in general the provisions are pretty much the same but worded differently. This is from memory, but as always I'm sure there will be more to come from others.

I am more than happy to be corrected, but the Fire Safety Order originates for Statutory Instrument 1541 2005 and is therefore surely a stand alone piece of legislation. Toe - where have you seen that the Order comes under the scope of the HASAWA??

If you get chance to read the court bundle for the new look fire on Oxford street comparisons were tried to be made but as messy says they are alone. Comparisons were attempted to reduce the outcome. I'd be interested too where it states otherwise.

I don't know if it is in the Scottish fire Order but they go hard for sprinklers in retail premises.

I stand corrected - I was of the opinion the RRFSO came under the HASAWA. It appears that the RRFSO is enabled by the Reglatory Reform Act 2001 (b).
