Can you tell me what the procedure is to safeguard workers doing work in domestic properties, where they might possibly come up against some type of Asbestos and disturb it? Obviously the Asbestos Regs are designed for NDP but what safety measures should be in place in domestic homes?

frank In short, the requirements are the same for domestic and non-domestic properties. In practice you are complying with HSWA s2 and 3, CDM Regs, and MHSWR for risk assessment. So you will need to carry out a R/D survey if you are going to disturb the fabric of the building, or if there has been an asbestos survey carried in the past to request a copy. Why CAR 2012 did not include domestic properties as well as the common areas I do not know. Ray

RR has got it right As for asbestos; if a worker a S:3 person or the environment [note the environment] became contaminated with asbestos then the person at work [the employer] would be in the firing line irrespective of the technicalities of specific law areas working in domestic environments for large landlords is hard enough but for individual domestic owners its very very difficult especially so as there are 100's of 1000's out there who offer services to domestic clients at cheap rates for what outwardly appears to the domestic client to be the same job when in the vast majority of cases its not best of luck

There is definitely no evidence of any survey being done. I know the answer i will get is "Can you imagine us drilling holes in their walls and taking samples before we start" but i can quote other Regs to them when they say "Aah, but the Asbestos Regs are for non domestic properties" Thanks chaps.

There are regulations and there are other regulations, but asbestos is always asbestos.

In practice, you will be complying with Regulations 5 - on of CAR2012. CAR 2012 Duties of the employer apply irrespective of the setting. Only Regulation 4 (Duty to Manage) discriminates.
