Folks, Over the weekend an incident occurred at my workplace where a lift truck toppled over. This was caused by the movement of the load it was carrying. The lift truck is fitted with ROPs and no injury was sustained thankfully. The incident is attributable to the operator; the FLT was both serviceable and in date for test etc and has passed inspection although it is now written off! My question is this; Do I have to inform the authorities under LOLER or any other legislation? The person involved is back at work and has just undergone refresher training. I have completed an 'in-house' incident report. Any suggestions or help would be gratefully received. regards, Thom

The overturning of a piece of lifting equipment is a reportable dangerous occurrence under RIDDOR. Chris

Blimey; sounds like the driver was lucky - I know I can only see what you have written here but this to me sounds like it needs more than an 'in house incident report' and 'refresher training' to find out what where why etc etc. Cheers Stu

The question is, is a FLT lifting equipment? Is so YES reportable; if not then NO. IMHO a FLT is lifting equipment, there might be other views. I have heard of a FLT driver being prosecuted under Sec 7 of HASAWA in a similar situation.................

Yep I agree with Chris42 according to schedule 2 of RIDDOR this needs to be reported to the HSE as a dangerous occurrence. http://www.hse.gov.uk/RI...dangerous-occurences.htm
