I have been attempting to find out more about the Social Action, Responsibility and Heroism Act (SARAH) Act 2015 but with only partial success.

Would any member be able to give an overview of the Act, its background and its aims and penalties.

Here is a link to it.

Until Case Law is developed under this act, the impact is hard to tell.

Looks like a lawyers charter....... again.

There are no penalties per se under this act, only whether you might have breached a duty of care or other Statutory duty etc.

The Act is short and looks pointless. It modified the civil law of negligence. It has no effect on the criminal law. It is intended to deal with the theoretical situation that might arise if someone, for the best reasons causes a loss to someone else, for example someone partially trained in first aid accidently makes someone worse or they clean snow off path and someone slips; that sort of thing. The specifically applies under the following circumstances:
•Social action(was the person was acting for the benefit of society)
•Responsibility (was the person demonstrating a predominantly responsible approach towards protecting the safety or other interests of others).
•Heroism. Was the person was acting heroically by intervening in an emergency to assist an individual in danger.
This has never happened in reality: the courts have taken a sensible view using the concept of reasonably practicable fairly effectively. This is just pandering to the Daily Mail readers etc

IMHO It was enacted to deal with an issue that the Daily Mail had imagined existed, but in reality did not.
