In a nutshell Ray.. Good article, thanks for the link. We in the h&s profession are not the only ones struggling to interpret and implement the regs!

I don't think the regs have ever said that the PD must be a designer on the project. Neither the draft nor the final regs said that. Some people assumed it, but you can hardly blame the HSE if people make assumptions that aren't what the regs actually say. I don't think it was ever an idea the HSE had - it's not in any of their documents that I've seen, anyway.

One guidance document, in the draft version, incorrectly said that the PD should be a designer on the project, and that was corrected in the final version. To my mind, that's an error in the draft of that document, not a backtracking in the regs.
