Would a building constructed in 2000 be classified as 'pre' or 'post' 2000 as far as determining the likelihood of ACM's being present?

HSE guidance below.
Was the building built or refurbished before 2000? If Yes, assume asbestos is present. If No, asbestos is unlikely to be present – no action required.

I would also establish what was there before. it's not uncommon for industrial sheds to be re-built on existing frame work or include existing floor slabs.

Thanks for the reply. The building was constructed IN 2000 (for argument's sake let's say commenced 1st Feb 2000 completed 30th August 2000). This is causing some problems as the client is saying no survey required and the contractor is asking for proof that no ACM's are present.

under such circumstances I would ask the developers to prepare a statement stating that construction started on 1st Feb 2000 and no ACM's were used in the construction of the building.
But check that no existing structure or floor slab was incorporated into the build.

This post really came down to the definition of what is pre or post 2000 is.
As the regulations on completely(ish) banning the importation and use of asbestos came into force on 24th November 1999, there should be no requirement to carry out an asbestos survey in buildings where construction commenced after this date (not withstanding risks from brownfield sites and installation of old equipment that may contain ACM's). Therefore should the guidance state 'buildings where construction commenced during or after 2000'?
