Was just wondering if anyone can offer advice on the following scenario, as I can't find anything relating to it anywhere online: -
I have an employee who claimed to have tripped over and sprained his ankle on the entrance step of the premises. There were no witnesses. This was entered into the accident book. He was then off work for 10 days, so RIDDOR report was filed. It has subsequently come to light that he lied about this injury, and it actually happened at home. How do I stand with regard to the RIDDOR report - can this be cancelled, and does this constitute fraud / gross misconduct?
Any thoughts gladly received, thanks.

You can amend RIDDOR reports after submission, see this link:

False reporting will normally be viewed as a disciplinary matter, due to giving false information and/or unauthorised absence. Speak to your HR people as to how that is handled.

Agree with Jimothy, that this is disciplinary matter. He has defrauded the company (wages) and been dishonest. I have seen this before and dismissal is usually the resulting action. Without firm handling the rest of the workforce will be doing the same.
Caution. Ensure that your evidence of his lying is concrete, enough to go to court. Ie strong and reliable eye witness, photos or doctors note etc. Dont rely on the casual word of a co-worker who may change their evidence at the last minute. been there.................

I would agree. Make sure you have explored all avenues in your investigation and pass this on to HR.

Can the Riddor be cancelled: yes it can I have previously retracted a Riddor based on further information coming to light, has other has said make sure it is concrete and not speculation.
Is this gross miss conduct : speak with your HR but where income from it would lead to a disciplinary investigation.

A false RIDDOR can be retracted. I also add to the report before retracting the fact that further investigation has shown the claim to be false.
It seems a bit pointless to do this but once done, I then use this on a gross misconduct charge.
I have had HSE query only once but my way does seem to be accepted by them.
