Hello All,
We have an old Victorian building that has been empty for 10+ years.
In 2009 old old Type 3 survey was carried out. Sample were taken and analysis showed 3 areas of ACMs
The building has been empty since.
Do we need to have a new R&D Survey carried out before we start work ?

It depends...a type iii surveys is the same as a R&D survey but it would depend if there was any caveats in the original type iii survey which may have prevented intrusive inspection and testing. It will also depend on what was found in the original survey and what was the condition of the ACMs.
Whatever was found in the original 2009 survey could have deteriorated and may now cause a significant risk. You don't state what work you will be carrying out or how adjacent the known ACMs are to the work. Taken everything into consideration I would instruct a new asbestos R&D survey to be undertaken with all the aforementioned details provided to the surveyor.

I would say yes, at lot has changed in the asbestos world since 2009. An old type 3 is not as rigorous as a R&D survey and the ACOP pushes you in that direction.
The regulations actually say “suitable and sufficient assessment as to whether asbestos, what type of asbestos, contained in what material and in what condition is present or is liable to be present in those premises”. So you could satisfy yourself that the old type 3 is suitable and sufficient but I suspect no contractor will accept it. It’s condition could also has dramatically deteriorated over 6 years.

Thanks both for your responses.
We had a licensed contractor in to look at removing the items highlighted in the old survey.
2 items can be just bagged and removed but the third is going to require the full sealed tent etc. at its in very poor condition - a piece of AIB under the boiler. This last piece is in a separate room and the area can be avoided until its removed.

I was asked this question a few years ago and as I don't interpret legislation I contacted the HSE and asked them.
The answer I got was we should work to current regulations which means a new R&D Survey was required.

Ray, of course they would, and did say that. However I asked for advice from the H&S Police and received it.
Now then, question is should I have ignored that advice or pass it on whenever the question is asked?

No worries. I doubt anyone would advise ignoring HSE advice, nor do I believe everything I'm told.
