Any help with the query please.
Are intrusive R&D asbestos surveys classed as "construction work" under CDM 2015

In the Regs it says
Construction work includes preparation for an intended structure, including site clearance, exploration, investigation (but not site survey)
It also says
(d)the removal of any product or waste resulting from demolition or dismantling of a structure a structure;

Is an R&D survey then investigation therefore construction work requiring compliance to CDM 2015 or site survey which doesn't fall under the definition ?
I think its also removal of a product.

It could be argued an asbestos survey is an 'investigation' and therefore CDM 2015 applies. Where asbestos samples are taken (Management or R&D) there is a more compelling argument that (d) applies.

Either way, does it really matter a hoot whether or not we consider CDM to apply to this activity? If it's preparatory to the construction phase, it's done in accordance with a well defined methodology and by competent persons we're good to go aren't we?
