Wouldn't disagree John, I have always found normally when I have started a new job that the Generic type of assessments are always out of date, been here since June and some GEEP's or other assessments are floating around with 2004 date on, despite the policy saying every 12 months review.

So we seem to be edging towards a general recognition that PEEPS are almost irrelevant when there are no staff present 24/7. Toe Whoever places the person needs to fulfil their section 3 duties where they are in business of placing persons in accommodation this maybe the LA, the NHS, a Charity or a Landlord letting direct. Perhaps we need to stop focussing on regulations and Regulatory Fire Orders and concentrate on the general requirements placed on ALL those operating a business. Certainly for people such as Ray they would be assisted enormously by an ability to cite primary legislation that places a clear duty on an organisation. A talk with the local HSE office might be fruitful!!?

All of this discussion seems to hinge on a Fire Service interpretation of "care services." I can't speak for England and Wales, however Scottish requirements lead to an interpretation of Public Services Reform (Scotland) Act 2010 Schedule 12—Care services: definitions. Which is as clear as mud! Fire Services may well have their own take on these definitions. If I were a provider of what, as others rightly say, is intended to be independent living accommodation, I'd be seeking proper legal opinion and interpretation before I embarked on any significant work, Risk Assessment or consideration of PEEPs etc.
