Good morning all,
I'm currently creating a list of applicable HSE Legislation and this has resulted in an issue that I don;t have the answer for.
If a regulation has been amended do you list the original date or the amended date?
For example:
The Control of Substances Hazardous to Health Regulations were first put on the Statute Book in 1988 under S.I. 1657.
But since that date there was three amendments then they brought out the COSHH Regulations 1994. There were then again three amendments until the COSHH Regulations 1999 and then 2002 were introduced.
Since 2002 we've had another further two amendments in 2003 and 2004.
This is where I don't quite understand it, do we sight the most recent date even if it's an amendment or do we always only refer to the most recent Regulation date without the amendment?

Who is going to use the list? Do they really care about that level of detail, or need to know?
If they want/ned to actually view the legislation, then add a link in your document to the most recent update. Or perhaps provide a catch-all statement about the website where it can all be viewed? (or 'sighted', as distinct from 'cited', which is what you are doing!).

COSHH Regulations 2002 as amended.
But you could just not put the date!

If the purpose is to verify complaince to the current applicable regulation the date becomes very important.
Appreciate CHiP is now a defunct regulation but in its history:
CHiP 1993 ->
CHiP 1994 (1996/1997/1998/1999x3/2000) ->
CHiP 2002 (2005/2008) ->
CHiP 2009

COSHH Regulations 2002 (as amended)

But a piece of legislation is not only amended by itself, but can be amended by other legislation, so any list you compile is not going to be entirely accurate. This is for an 18001 audit isn’t it and I have had discussions with auditors about this as he insisted that I list every amendment. Now with different auditing company.

When I did my law degree we were advised to put the date followed by 'as amended'. Probably due to the fact there can be numerous amendments for one statutory Act or Instrument.
