Does anyone share my opinion that Landscape Gardening businesses (not gardening maintenance) should come under the CDM regs?

Only IF they are working on a site that is already subject to CDM. Their operation is strictly Horticultural NOT construction except in the outlined circumstance.

Are you talking about hard landscaping ? ie I watched Chelsea flower show on TV and one garden had a wooden structure with a 5 tonne boulder on top of it. Other gardens in previous years have had elaborate steel and wooden structures etc. Is this the type of thing you mean ?

Hmm. Usually involving a design, a planned sequence of works routinely including earth moving, excavation, drainage, erection of structures (walls etc.), segregation of the works, traffic management, material delivery, ride on plant, provision of welfare etc.

Sound familiar?

I'd go with HSE rule of thumb. If it looks like construction work and involves construction plant and equipment, then it IS construction work.

The Project needs to be managed safely. Why wouldn't you employ the principles of CDM?

Thanks for that Ron, I think we both agree on the type of work being carried out. And yes it is hardlandscaping.
