Information I requested from the HSE Fee for Intervention (FFI) team has revealed that the total value of FFI invoices issued in the construction sector has increased by over a quarter (26%) during the last 12 months of recorded data. Up to March 2016. Construction sector FFI invoice total value has increased from £2.5m to £4.2 in the last three years and the average invoice value has risen from £366 to £604. During the same period the number of enforcement notices issued in the construction sector has fallen from 3617 annually to 2783. Is FFI now being used as a 'cash cow' and notices of contravention replacing formal notices?? What is your experience?

It easy to perceive this as being so, but statutory notices cannot replace the FFI notice for material breaches. However, the FFI notice may result in an IN with the bonus of more time and more money for the HSE.. add another inspector and you can double that !

Ali - a material breach can attract either a notice of contravention letter or an enforcement notice. HSE inspector just needs to be a bit more certain about evidence for the latter although both are based on inspector opinion at the time.
