Hi, my employer recently purchased a piece of equipment from outside the EU and began the process of CE marking it. They've now decided that it no longer fits with their plans and are giving it away (zero charge) to a company in mainland Europe. 

My understanding is that even though we're disposing of it for free, it should still be CE marked. It has not been marketed, advertised or in any other way placed on the market. Its an agreement between two CEO's. 

Thoughts welcomed.

Guess you will have to read the exact definitions in the Supply of Machinery Regs, and if you can truly proove that the machine has never been used within the UK/Europe.

Also the definition of 'supply'.

Sorry I don't have time to read up on the detail, but I think you would still be classed as a supplier, even if giving the machine away for free - hence CE marking is required. Maybe you can get the new company to pay for the CE marking?
