Hi, Ive been involved with an incident in which a lifting truck over turned, the truck is a compact type that lifts a cage of items up to a mezzanine floor for storage or down for despatch. . it has been determined that it was not a mechanical failing , and was infact incorrect positioning of a containment cage containing items, that took the tuck out of its safety stability triangle .
Riddor states that Collaspse , overturning of failure of load dearing part should be reported , they then go on to say failure in the context referes to componants that suffer mechanical breakdown during normal operation .
As no mechanical failure has occured - is this reportable under RIDDOR ?
I know the standard answer is "report to be covered" , but im just wondering if this is to the letter a "reportable" incident as the investigation has shown the truck to be mechanically sound.

I would suggest that those three clauses are separate, they don't all relate to the load bearing parts. What would be the point of saying 'collapse of' or 'overturning of' a load bearing part? Aren't they covered more broadly by 'failure'?
I read it as 'overturning ... of any lifting equipment'.

Agree with Xavier123, they are three separate conditions (Collaps or Overturning or Failure of load bearing part). They go on to clarify failure, but that is only for condition 3 the failure of load bearing parts. If you had a crane on poorly made up ground and as a result it toppled over that would be reportable, even though there was no failure of the equipment.
Sorry I think it is reportable.

I have to agree with all the comments made so far in that they are 3 sepearate conditions. But this is a dangerous ocurance whether machanical or not. Chris 42 makes a sound point in the crane senario. This incident could have easily lead to a serious injury or fatality and should be reported under RIDDOR
