I have a client  that manufatures prefabricated modules for transportation to site. The modules are fully kitted out so the only thing to do on site is put them in position and connect them up.

I think this puts them under CDM but previous advisors have said that it doesn't.

Please can someone help me confirm if I have misunderstood the regulations.

From my own humble opinion, definately comes under CDM 2015 regs - as regulation 2 does include the words "the assembly on site of prefabricated elements to form a structure etc" - assuming that it is a structure being produced. There are other points in regulation 2 of the guidance that would also seem to affirm that this task comes under CDM 2015.

Thanks Alfasev. Please can you confirm why you think this. They are building a structure albeit one that goes into another on.

In the same way that the manufacturing of bricks, plasterboard, timber, light fittings, doors, boilers, kitchen units, etc don't come under CDM regs

What difference does it / will it make?

Seriously - assuming you are managing the risks effectively already, what practical things would you add if CDM did apply?

Sadlass, I was trying to confirm to ensure that their Legislation Register is correct. It will probably be there because of the design element but I wanted to confirm if the manufacturing side of the business was also subject. I know whether or not the CDM regs apply makes no difference to the safe management of the risks involved in the works however it may affect them in regards to their duties if they are.

CDM defines construction work as building, civil engineering and engineering construction works.  It is accepted within the construction industry, including the HSE that modular units are manufactured in factories and therefore CDM does not apply.

However the devil is in the detail. As soon as you carry out tasks on a development site CDM applies to those tasks.  You will also be classed as a designer under CDM as you are supplying a significant element of the structure.
