Hi can anyone please tell me if they are aware of any legislation or guidance which stated a minimum age for asbestos surveying and sampling? I am looking to employ an 18 year old as a Trainee Asbestos Surveyor but can not find any information on age restrictions. I am aware that you cannot work in the Asbestos Removal Industry until the age of 21 but there is nothing that refers to surveying and sampling. Thank you

Just out of interest, where does the minimum age of 21 to work in the asbestos removal industry come from ?.

I assume the 21 years rule you are alluding to is from your insurers, perhaps? I don't know of any rule in the legislation or ACoP.
As for a young surveyor, I would ask whoever it was that told you of the 21 years and over ruling and ask them exactly where you can reference that information. If there is such a thing then it is likely to be the source of your answer - and in which case please post here and let us know!
Personally, I don't see why being 18 years old should preclude them from learning a career.

I was advised by a Removal Company that his is the case. However it may be right that this is more of an insurance requirement than a legislative one. Thank you for your responses

This may be to do with the human body not being fully developed at age 18 years and the lungs may be prone to damage which would stay with the person for a lifetime.
I heard this when my son was an apprentice and he developed a severe cough which he never got rid of. He was 16 at the time.
The cause of the cough was inhaling the products of E-cigarettes in a confined space. Three smoking in a small workshop. He is 18 now and still coughing.
This is an opinion based on my personal experience so please don't start a big issue about E-ciggies.

You have been misinformed. There is nothing in the applicable legislation or guidance concerning asbestos that requires someone to be 21.

Agreed. This sounds like a insurance issue. Check with you underwriters what the conditions of your insurance are with this respects. Very specifically you need to check this against the terms of your businesses Employer Liability Insurance. If the detail were that they don't recognise folk under 21 in this role, then you would be employing someone who is not covered by ELI and you would be in the area of breaking the law, as ELI is compulsory. However, I suspect it won't be an ELI issue, but such a business/public liability one.
