A friend of mine has to walk along an unlit public footpath to get her work from the car park provided by the company.  Section two of the 1974 act makes provision to provide safe entry and egress,  will this include the public footpath as that is the only way to get to the entrance from the company car park?

Hi

IMO the public footpath is the council resposibility, so i would contact them about the lighting and the safety issue you have.

saying that, have you thought about the lighting in the car park which is under your control. so why not adjust some of the lighting so it covers part of the path and give some light to it.

Your post answers its own question - an employer has obligations regarding access and egress to the work place. A public footpath by its description is not classed as a workplace and is beyond the control of the employer.

You could try contacting the local council but given many are now switching off street lights to save money (including sections of motorway where I live) I don't believe the situation would change.
