Can a principle designer pass on their duties to the principle contractor  and if so who does the client retrospectively appoint. We have already appointed the PD and they want to pass on the responsibility. We are denying this action but need to be confident in our actions

A Principal Designer can last as long as the Pre Construction Phase takes. If there is no futher design work the PD role can cease and the PC can take over control of the H&S file.

If there is continuing design or temporary works design works which ceases before the end of the project a PD must be appointed (the client takes on the role by default for commercial properties) while design continues.

If the design or PD appointment continues to the end of the project, the Pre-Construction Phase and the PD appointment needs to continue to mirror the Construction Phase for the PD to deliver the H&S file to the Client.

The PD role can be carried out by the PC if they have the capability.

Hope this helps. Has all the design work been completed?

The Client appoints the Principal Designer - in some circumstances the role of PD is migrated over to the Principal Contractor at the start of construction. This would ushally be a Design and Build project. This is done in writing by the Client, not the PD simply saying it is your job now.
