My understanding of the WTD is that you must have an 11 hour break between shifts, so working 7:30am till 5pm gives that 11 hours break.  But if the employee works overtime until 9pm does that mean he cannot come in until 8am or could he then tag the hour needed to get and 11 hour break in 24 hours onto his end of normal shift and finish at 4 the next day instead of 5?

I don't know for sure, but when I worked in the railway industry it was common practice for personnel to have a mandatory 12 hour break between shifts. If for any reason the shift should finish later than planned then they could not resume work until the full 12 hours had passed between shifts. After all, its 12 hours rest (11 in your case) and not 11.5 or 11.25.

Unless the workers come under regs 18 or 21 of the WTD, then there must be a workforce agreement (reg 23) in place that lets you modify the daily rest period (reg 10). Otherwise its the 11hr rest between shifts.

Thank you both for your replies and reading the reg / sections it doesnt mention overtime or extra hours so presume these are classed as "your shift" so if they continue working overtime until 9pm starting before 8am doesnt give them enough rest time.
