Hi All,
First time poster here so be gentle...
A member of staff was injured whilst at work having opened the blinds. She claimed that she opened the blinds as she would every day, there was no problems reported with the blinds and they have been inspected since and are in fine working order. Following this, she completed the rest of her shift. She returned the following day to work but then realised the pain was unbearable. Since attended the doctors who states it's suspected ligament damage which has resulted in her being off work for approx 15 days.
This has not yet been reported, is this the correct stance?

Hi Ryan, the defining factor here under RIDDOR for me is whether or not the IP was carryng out a work activity? It sounds to me that she was at work, however she was not carrying out a work activity. Blinds get opened and closed loads of times it sounds unlucky that she injured herself but I would only record this in the accident book and obtain a statement from her. I would not report this to RIDDOR.

There has been debate on this before and you'll find contradictory opinions on this, but .... what 'accident' has occurred? Check the actual wording under RIDDOR and the words accident (not activity) and injury are very much separated therefore do not and should not mean the same thing. The HSE give a guide on the definition of accident and it is essentially an unintended, identifiable event (haven't double checked exact wording so someone should feel free to pick me up on this). There has been an injury but the HSE are explicit that does not in itself constitute an accident.
The potential lack of RIDDOR does, of course, not mean that you shouldn't look at the individual and the actions and twists etc. they are undertaking during this daily task.

Thanks for the replies Xavier and DHM, you have reaffirmed my viewpoint and as such i am fairly confident that a report to the HSE is not required.
